A nationwide salmonella outbreak in peanut butter products is responsible for killing two elderly patients in Minnesota according to a lawsuit that has been filed. The lawsuit filed by a Minnesota law firm states that nursing home patients Shirley Mae Almer and Clifford Tousignant both died because of salmonella poisoning.

The two resided in two separate Good Samaritan nursing homes in Minnesota. The wrongful death lawsuit is being filed against King Nut of Ohio and Peanut Corporation of America in Lynchburg, Virginia. Several companies including Kellogg and Keebler have recalled products using the peanut products.

A year after Carlos Sousa, Jr., a 17-year-old was mauled by a Siberian tiger at the San Francisco Zoo, his family has filed a wrongful death lawsuit. On Christmas Day 2007, a 243-pound tiger, Tatiana, mauled the youth and injured his two friends, Paul and Kulbir Dhaliwal.

Police investigators at first said that taunting may have been involved in the case, but have brought no charges against the youths. The family of the Dhaliwals have claimed their was a smear campaign by police and have filed claims for personal injury and character defamation.

In San Jose, California a federal jury awarded the family of Robert Heston, Jr. $6 million after the man died due in part to being repeatedly tasered by police. Taser International of Scottsdale, Arizona the maker of the taser guns were found to be responsible in the death of Heston.

According to the jury, Taser International failed to inform police that its product could be dangerous when used upon someone who was on drugs or in combination with chest compressions. Heston was tasered as many as 30 times after police were called to the scene.

There is a wrongful death lawsuit against ex-Bolivian president Gonzalo Sanchez de Lozada that has been consolidated this week in Maryland. Also implicated in the case brought forth by 10 Bolivians living in the U. S. is ex-defense minister Jose Carlos Sanchez Berzain.

Both ex-President and ex-defense minister fled to the United States seeking asylum. The plaintiffs’ lawyers are claiming that in 2003, the defendants took inappropriate governmental action that resulted in the killing of 67 Bolivians and that the defendants put themselves under the jurisdiction of U. S. law by fleeing to this country.

Approximately 90 New York residents have filed a toxic tort lawsuit against IBM that they say caused birth defects in infants and cancer in adults. The lawsuit claims a toxic plume of chemicals including trichloroethylene was released from an IBM plant into the soil, groundwater and air.

According to the seven law firms representing the clients, the toxic chemicals caused personal injury and wrongful death to family of the plaintiffs. One of the law firms included in the case is Masry & Vititoe made famous by the movie “Erin Brockovich.”

The daughter of deceased door-to-door surveyor, Summer Shipp has filed a wrongful death lawsuit against the company her mother worked for. Brandy Shipp has stated that marketing research firm GfK NOP, Roper ASW did not do enough to protect her mother from the perils of door-to-door marketing.

The lawsuit says the marketing firm was negligent in several areas including not checking assigned areas for sexual predators and not giving employees equipment to protect themselves. After missing for three years, the remains of Summer Shipp were found in Jackson County, Missouri in October this year.

The family of 4-year-old Daviay Legrand, who was killed by police responding to an emergency call is suing for $8 million. A rookie officer for the Allentown, PA police department ran a red light, pushing another officer’s car into two children who were observing from the sidewalk at the time.

Daviay’s mother and two siblings witnessed the car running into Daviay and Jason Marcelle who suffered two broken legs as he tried to pull Daviay to safety. The city’s liability in this case is limited to $500,000 for all victims.

The rookie officer has a history of receiving speeding tickets before joining the police force and remains suspended without pay. The police union has filed a grievance in order to have the rookie officer returned to duty.

In Atlanta, the niece of 92-year-old Kathryn Johnston has filed a lawsuit for wrongful death. Last November, police conducted a drug raid based on a faulty tip from an informant.

Narcotics officers burst into Johnson’s home on a no-knock warrant, inspiring her to fire at the unknown intruders in self-protection. Police fired back, killing the woman. Two officers have already plead guilty to manslaughter while a third is awaiting other charges.

The wrongful death lawsuit is expected to be filed within the next two weeks. A claim has already been made by the niece, which usually precedes litigation.

Virginia Tech University today became the site for the United State’s deadliest shooting rampage in history. With more than 30 dead and 17 hospitalized an unidentified gunman committed two shootings at the university more than two hours apart before turning the gun on himself and committing suicide.

Two students were killed at the West Ambler Johnson dormitory at 7:30 am EST and 31 more students were killed two hours later at 9:30 am EST at Norris Hall. Campus authorities have been quoted as saying that they thought the shooting at the dormitory was a domestic dispute and that the gunman had fled the campus.

Surviving student who were interviewed complained that they did not receive a warning about the initial school shooting until over two hours after the incident. Several sources have already stated that massive negligence and wrongful death lawsuits will ensue, stating that Virginia Tech University had a duty to warn students of the potential danger much more quickly and that had this occurred some of the deaths in the second shooting may have been avoided.

In Pasco County, Florida a woman choked to death on a piece of steak after her boyfriend called 911 for help. Chris Cooper of Land O’ Lakes, Florida called 911 after getting out of the shower and realizing that his girlfriend, Nancy McGhee was gasping for air and pointing to her neck.

According to reports, the 911 operator tried wholeheartedly to assist, but since she was not yet trained in emergency medical dispatch (EMD), she repeated asked her supervisor, who did have training, for help. The supervisor refused several times before acquiescing and trying to help tell Mr. Cooper how to do the Heimlich Maneuver. A second supervisor, a female, refused to get on the phone altogether.

There has been no word yet on whether or not the family of Ms. McGhee intends to bring forth a wrongful death lawsuit against the 911 supervisors.
